Article 1: Setup & Use

Siemens offers its employees the opportunity to participate in the company fitness program. High Five Health Promotion B.V. (High Five) provides this service.

Article 2: Participants

The following persons may use the Studio Active Erlangen facility at Schuckerstraße 1:

  1. Employees (both permanent and temporary) of Siemens AG, Siemens Mobility GmbH and Siemens Financial Services
  2. Family members of active SAG, SMO or SFS members
    • who live in the same household as the active member
    • are over 18 years of age
  3. Employees (permanent and temporary) of all companies that have ‘Siemens’ in their name (see list):
    • Siemens Bank GmbH
    • Siemens Electronic Design GmbH
    • Siemens Energy Global GmbH
    • Siemens Finance & Leasing GmbH
    • Siemens Healthineers AG
    • Siemens Industry Software GmbH
    • Siemens Project Ventures GmbH
    • Siemens Treasury GmbH
  4. In exceptional cases, Siemens will decide whether participation is possible.

Article 3: Registration

Registration for health and fitness activities takes place digitally via High Five Connect. Participants can register via the homepage and view their test data, invoices, direct debit authorisations, training programmes, bookings and opening hours on their personal High Five Connect page. High Five operates in accordance with the GDPR. During registration, new participants are explicitly asked to consent to the processing of their personal data. Participants are also asked to agree to the health agreement and house rules.

Article 4: Start of Participation

Before beginning the training programme, High Five recommends that participants take a fitness test. As part of the check-up, High Five conducts a medical history check. If The questions and answers in the medical questionnaire do not reveal any serious physical limitations, Participation in the health and fitness activities can then begin immediately. However, High Five reserves the right to refuse participation in the training programme if the participant has any serious physical limitations.

Article 5: Reporting Injuries

If a member becomes aware of an injury or wound, they must report it to a member of staff before the start of training, in accordance with the Health Agreement.

Article 6: Liability

Participation in High Five activities is entirely at the participant’s own risk. Neither Siemens nor High Five can be held liable for material damage, personal injury or any other kind of damage, or for loss or theft, unless this is the result of malfunctioning equipment due to improper maintenance or supervision of safety in this area. All equipment must be used for its intended purpose only. If a participant is unfamiliar with a piece of equipment, they must read the operating instructions and follow them when using the equipment. If there is any uncertainty in this regard, especially before using a piece of equipment for the first time, instruction must be obtained from the gym operator or their employees. All facilities, training equipment and training areas must be treated with care and respect. Personal belongings must be stored properly in the designated storage boxes and must not be left in the gym. Members must refrain from making unnecessary noise, harassing other members, or endangering them in any way.

Article 7: Reporting defects & malfunctions

If a member notices that a device is not functioning properly, they should report the issue to a High Five employee immediately.

Article 8: Hygiene

The use of a towel during training is compulsory. Each participant must clean and/or tidy up any equipment or materials they use. Participants must wear clean training clothes and indoor shoes. Training in the training area in flip-flops, bare feet or open-toed shoes is not permitted. We recommend wearing bathing sandals in wet areas. Please leave all rooms clean and tidy. At the end of your workout, please remove all items from the lockers as reservations are not possible. High Five reserves the right to remove any items left in lockers or rooms.

Article 9: Food & Drink

Eating is forbidden in the training area. Chewing gum is also prohibited during training. Furthermore, only sports and water bottles are permitted for drinking in the training area (no glass bottles).

Article 10: Opening hours

During these hours, all members can use the fitness facilities as much as they like. Details of supervised opening hours and activities can be found in the overview of bookable hours on the personal page in High Five Connect. An alternative schedule may be implemented during vacation periods. Participants can register for group courses and other activities via High Five Connect. Participants who are unable to attend a group course are asked to cancel their booking at least one hour before the course starts, thus allowing other members to participate.

Article 11: Schedule Changes

High Five may make schedule changes with Siemens’ consent.

Article 12: Payment of membership fees

The monthly membership fee must be paid in advance by direct debit. Before participating, a direct debit authorisation must be signed if paying by direct debit. A deposit of €10.00 is charged for the membership card. This will be refunded upon termination of membership and return of the card. If the card is lost, a replacement card will be issued for an additional charge.

Article 13: Termination

Notice periods and terms:

The monthly membership will be automatically renewed for one month after the end of the initial term, unless written notice of termination is received. “Ticket of Ten” are paid for in one instalment and cannot be cancelled once the first training session has begun. Members are required to check in independently before training. The check-in system automatically deducts the credit stored on the membership card. Membership can be terminated with four weeks’ notice at the end of the month. Members must send termination notices by email to fitnesssiemenserlangen@highfive.fit. High Five must receive the cancellation notice before the first day of the month. Cancellations received after the last day of the month will be processed the following month. Each participant is asked to state a reason for cancellation. Emails will be confirmed and processed by High Five. Membership can be temporarily paused in the event of injury and/or pregnancy.

Article 14: Complaints and/or suggestions for improvement

Participants can pass on any complaints and/or suggestions for improvement to an employee or the contact person at Siemens. Complaints and suggestions can also be submitted via the website: highfive.fit/en-int/contact-us

Article 15: Photos & videos

Written permission from the Communications Department of High Five and Siemens is required for all photos and/or video recordings.

Article 16: Rules

We assume that all participants have familiarised themselves with the General Terms and Conditions and the House Rules. The current House Rules can be viewed in the contract and in the gym. High Five and Siemens reserve the right to amend the House Rules.

Article 17: Unforeseen Circumstances

In cases not covered by the rules, Siemens and High Five will make a decision.

Article 18: Extension of opening hours (unsupervised)

Members are aware that High Five staff are permanently on site from 6:30 a.m. to 8.30pm, and Fridays from 6.30am to 7pm (regular opening hours). Using the premises and training equipment outside these hours is at the member’s own risk. There will be no High Five supervision during this period, so constant safety cannot be maintained. The member will be using the premises and training equipment unsupervised and without instruction from High Five or commissioned third parties. Therefore, during these periods, the use of the premises is at the member’s own risk. The member acknowledges that the combination of training and associated physical exertion with a lack of supervision creates an increased risk, especially since physical or health emergencies may not be detected immediately due to the lack of staff. The member consciously accepts this risk.

The member acknowledges that the entire area outside regular opening hours is a self-check-in zone, and that they must inspect the premises and training equipment for safety issues before use. Deficiencies or risk areas may arise if previous users have used the premises or equipment improperly or left them unsecured, for example. The member is responsible for assessing their own abilities and state of health before training, i.e. whether they are physically and/or medically capable of using the facilities independently. However, this exclusion of liability does not apply in cases where High Five, its representatives or vicarious agents have acted with intent or gross negligence, thereby causing the damage themselves. The same applies in the event of a culpable breach of essential contractual obligations. In cases of simple negligence, it also does not apply in cases of injury to life, limb or health. Liability for culpable injury to life, limb or health remains unaffected.

Unless expressly stated otherwise above, High Five’s liability outside regular opening hours is excluded.

Important information for training outside regular supervision hours

To ensure that training runs smoothly and safely outside regular opening hours, please observe the following steps:

  1. Register before each training session.
    Before each session, you must sign in at the SP10 reception desk.
  2. Deposit and issuance of access card:
    Your company ID card and membership card must be deposited with the security staff at the SP10 reception desk. In return, you will receive an access card for Studio Active and a locker key.
  3. Return after training
    After your training session, you must return the access card and locker key to the SP10 reception desk. Only then will you receive your company and membership cards back.
  4. Compliance with the rules
    The house rules and terms and conditions must be observed at all times during training.
  5. Reporting procedure:
    By accepting the extended terms and conditions, the member also accepts the current reporting procedure.

Reporting procedure for defects & missing equipment

In order to ensure that our gym runs smoothly 24/7, it is important that any defects, signs of wear and tear or missing equipment are reported quickly and reliably. We have therefore established the following reporting procedure:

When must a report be made?

A report is required if you notice any of the following outside of regular support hours:

  • Defective equipment
    (e.g. a treadmill not working, a torn cable pull or a stuck weight stack)
  • Signs of wear and tear
    (e.g. damaged padding, loose handles or worn-out cable pulls)
  • Missing equipment
    (e.g. dumbbells, mats or resistance bands cannot be found)

How the reporting procedure works:

  1. Report any damage or missing equipment when returning your access card and locker key.
    After your workout, report any damage or missing equipment directly to security when you return your access card and locker key to the SP10 reception desk. This ensures that problems are recorded promptly.
  2. Entry in the report list
    Security will enter your report in a list of defects/faults, which is regularly checked by our fitness team. If necessary, add a brief description of the problem to your report.
  3. Forwarding to the studio team
    Our team checks the reports entered daily and takes care of repairing defects or replacing equipment. In the case of major repairs, the responsible technician or manufacturer will be informed as soon as possible.

Please report any problems immediately when returning your access card and locker key.
